Terms & Conditions1.1 The London Flower Company is wholly owned by English Boxes of Mayfair, a Florida registered US company (company number 872118362). 1.2 These pages tells you the terms and conditions under which we supply our products. Please review these Terms & Conditions carefully as by using this website you accept and agree to be bound by these Terms and Conditions of Sale, the Privacy & Cookie Policy and such other policies we notify you of from time to time, which together constitute the entire agreement between us. These Terms apply to all users of our website, including without limitation, users who are browsers, customers, merchants, vendors and/or contributors of content. If you access and use this website, you accept and agree to be bound by and comply with the Terms and our Privacy Policy. These Terms & Conditions also govern the sale of goods by us to you and will form the basis of any contract between us. Please read them carefully before placing your order as you will be deemed to be bound by them.2. How the contract is formed2.1 The terms “we”, “us”, and “our” refer to English Boxes. 2.2 When you place an order with us, you are making an offer to purchase goods from us. We will send you an email to confirm that we have received your order. The contract will become binding once we have sent an order confirmation to you. If we cannot accept your order, we will notify you.2.3 In the unlikely event that the goods are no longer available, we will advise you of this. Your order will not be placed and there will be no contract between us pending further instruction. 2.4 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website and will not include any of the pictured surrounding accessories, unless stated in the specification of the goods. 2.5 We have made every effort to display as accurately as possible the details of our products that appear on this website. 2.6 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.2.7 We have made every effort to ensure that the goods and packaging displayed on this website conform to the descriptions and photographs. The colors, specifications, dimensions and descriptions of items on the website are quoted as accurately as possible, but please note that all images are for illustration purposes only. The colors you see will depend on the resolution of your monitor and we cannot therefore guarantee that your monitor's display of any color will always reflect accurately the color of the items delivered. We reserve the right from time to time to vary the content, packaging, dimensions, specifications, descriptions, colors and quantities of items displayed on our website without prior notice. 2.8 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.3. Orders3.1 The buyer accepts full responsibility for checking the accuracy of the order made. 3.2 The buyer assumes responsibility for the goods being suitable for the purpose for which they are being purchased. 3.3 Carriage charges will be shown prior to you placing your order. 3.4 All payments for goods must be made at the time of ordering. We will not reserve nor dispatch goods before payment is received. Your payment will be taken immediately and we aim to dispatch your order within 48 working hours. If there will be an unreasonable delay we will contact you. Please note that due to Covid19 some orders are taking a little longer. 3.5 We use secure payment facilities for online purchases. You can pay for your order by American Express, Visa, Mastercard or by PayPal. 3.6 Promotional prices, if applicable, only apply during the period stated. 3.7 All prices quoted on our website are in United States dollars $ USD. All payments shall be made in United States Dollars $ USD. Please note we cannot be held responsible for adverse currency fluctuations. The conversion rate is set at the point of authorization by your bank of your credit/debit card. 3.8 Prices are liable to change at any time, but changes will not affect orders of which we have already sent you an order confirmation. 3.9 If a pricing error occurs, we will either contact you for instructions before dispatching the product or reject your order and notify you of the rejection.3.12 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays. 3.13 If an item is out of stock, we reserve the right to substitute the said item with a similar item, without notifying you.CORPORATE ORDERSFor corporate orders in addition to the payment methods mentioned above, payment by bank transfer may also be accepted.4. Delivery & Courier4.1 We aim to dispatch all boxes within 48 working hours, but this is dependent on stock levels. We use multiple couriers to ensure the most appropriate service. 4.2 We deliver globally every day. If you order products from our site for delivery outside the USA, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount.4.3 Customs authorities may request personal information when inspecting your parcel; failure to provide this information to Customs will result in the parcel being returned. We therefore recommend that the recipient’s telephone details be included with the order. In this instance we are unable to refund the cost of postage and packaging. For items you order, you are considered to be the importer of the products and must comply with all laws and regulations of the country to which the items are to be delivered. Please note that cross-border deliveries are subject to opening and inspection by customs authorities. We cannot guarantee that your goods will arrive in the same condition that they were dispatched should they be subject to inspection. 4.4 Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.4.5 If you order a number of items for delivery to the same address, they may be dispatched separately and we cannot guarantee delivery on the same day unless specific date delivery is selected. We make every effort to dispatch items on time.4.6 All deliveries are to an address (which must be correct) not a named individual. If a delivery at that address is not possible, you may be given options to leave the parcel with a neighbor, at a safe place or for delivery to be re-attempted or collection. If the delivery subsequently still fails or the delivery is refused by the recipient (e.g. an unwanted gift) then the goods will be returned to our Distribution Centre and you will be contacted for instructions to where the goods should be delivered. Refunds will not be available in these circumstances. If we are unable to make contact, the returned items will be sent to your address and you will be liable for additional costs. Any additional delivery charges incurred due to errors by you upon ordering may be passed on to you.4.7 We make every effort to dispatch items on time, although delivery times may vary according to availability. Any guarantees or representations made as to delivery times are limited and subject to any delays resulting from postal delays or force majeure (e.g. weather) for which we will not be responsible.4.8 We are not liable for any loss due to late, damaged, incorrect or lost deliveries.5. Cancellations and returns5.1 Once an order has been placed and confirmation sent, an order may not be cancelled by you or refunded by us.5.2 Our gift boxes contain perishable goods, therefore, our gift boxes are excluded from your statutory right to return purchases and receive refunds. 5.3 This cancellation policy does not affect your legal rights - for example, if goods are faulty (see below).6. Faulty Goods / Guarantee6.1 If there is a problem with the goods, you must notify us within 24 hours of receipt of the goods by email providing details of the problem. In addition, you must provide us with a photograph of the problem as this may save you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights.6.2 Sealed items where the seal or cellophane has been broken will not be eligible for return even if faulty or damaged. 6.3 Our gift boxes contain perishable goods, therefore refunds will not be issued. If an exchange is necessary, this will be arranged without unreasonable delay and without charge to you. Replacement goods will not be dispatched until either an indicative digital image is supplied by you, or the original goods have been received by us and checked. The cost of returning goods to us is your responsibility and we are not obliged to repay you for any costs that you have incurred in returning the products to us. However, on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we may return them to you, in which case you will be required to cover our reasonable postage costs.6.4 Due to the potential transit time, we are not responsible for perishable items and goods. During the summer months some products, especially chocolate, may melt during transportation. All orders containing such products are shipped at the customer's own risk. Once dispatched, we are unable to control the temperature that the goods are shipped at. We ship our orders in cardboard boxes with no additional method of protection for the items inside. We make every effort to make sure customers are aware of this - therefore we cannot be held responsible if the buyer chooses to purchase items that then become damaged by the heat. We will not take any responsibility for chocolate items which melt in transit - any chocolate orders are placed at your own risk. 6.5 If a faulty item is no longer available, we will offer an alternative, either the original product, or as close to the original product as possible. However, our liability will be to replace the faulty goods only and we may be unable to guarantee an exact match.6.6 Where we replace faulty goods you are responsible for their disposal if they have not previously been returned to us.7. Liability7.1 All descriptions, product images and weights are those of the original manufacturer and are intended to give a general description of the goods. The weight to be shipped includes the weight of packaging for the goods.7.2 We warrant to you that any product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied. 7.3 Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the product you purchased.7.4 Products may contain nuts, dairy and other allergens and the purchaser is responsible for checking the suitability of all orders.7.5 Items are edible and fit for human consumption (unless otherwise stated) with an acceptable expiry date.7.6 We accept no liability and shall not be responsible for any indirect, consequential, special, economic or exemplary losses or damages however they may arise, whether foreseeable or otherwise.7.7 We accept no responsibility whatsoever and will not be held liable for any personal injury, illness or death relating to consumption of our gift boxes including, but not limited to, choking, food allergies and intolerances, food poisoning or products given to minors, whether supervised or unsupervised.7.8 We will not be responsible to you for any delay or failure to comply with our obligations under these Terms & Conditions if the delay or failure arises from any cause beyond our reasonable control.8. Risk & Title8.1 The Products will be at your risk from the time of delivery. 8.2 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.9. Website Disclaimer - Use of Website9.1 This disclaimer details our obligations to you regarding our website. Please read this disclaimer in full before you use this Website. Using the Website implies that you accept the terms of this disclaimer. We do occasionally update this disclaimer so please refer back to them in the future. 9.2 You are permitted to use our website for your own personal purposes. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore, we will not be liable if this website is unavailable at any time. 9.8 Any links to third party websites located on this Website are provided for your convenience only. We have not reviewed each third party website and have no responsibility for such third party websites or their content. 9.9 If you would like to link to this Website, you may only do so on the basis that you link to, but do not replicate, any page on this Website and you do not in any way imply that we are endorsing any services or products unless this has been specifically agreed with us. If you choose to link to our website in breach of Paragraph 4.2 you shall fully indemnify us for any loss or damage suffered as a result of your actions. 9.10 We take all reasonable steps to ensure that the information on this Website is correct. However, we do not guarantee the correctness or completeness of material on this Website. Neither we nor any other party (whether or not involved in producing, maintaining or delivering this Website), shall be liability or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss.9.11 If you breach these Terms & Conditions and we take no action, we shall not be deemed to have waived our rights to enforce the Terms & Conditions.
10.Subscription Services - Subscriptions may be cancelled at any time by you, providing two consecutive payments have been taken. Cancellation of subscription must be made in writing via email. By purchasing a subscription, you agree to an initial and recurring fee to be taken from your provided credit card. You accept responsibility for all recurring charges until you cancel your subscription. If we do not receive payment from your credit card, your credit card expires or is rejected, delivery of goods ordered will be forfeited. Payment for all subscription services will be taken from the provided credit card, one week before delivery of goods.
Gift Cards The English Boxes Gift Card E- card is a digital gift, which when purchased creates a unique code. The gift card recipient may enter this code at checkout to subtract the gift card value from their order total. The English Boxes Gift Card E- card contains value which may only be used to purchase items at English Boxes. It cannot be redeemed for cash in whole or part. Use of this E-Card constitutes acceptance of these terms and conditions. Gift Messages A personal gift message of up to 250 characters can be included with all orders. Please note that 'special' characters, clip art images, emoticons, etc. are not recognized. Please decide on your message before placing an order as an amendment after the order has been placed may not be possible. The gift message will be placed on the inside of the box.
We reserve the right at any time to make changes to these Terms & Conditions, Privacy & Cookie Policy and such other policies as we may notify you of. You will be subject to the policies and terms and conditions in force at the time you use the website or place an order from the website or other means. We may transfer our rights and obligations under these terms to another organization. However you may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not affect the validity and enforceability of the remaining terms and conditions.
